  1. Terms and Conditions  

These Terms and Conditions govern your use of the ROTOR America service and website. By visiting the ROTOR website, you accept, and agree to, the content of these Terms and Conditions. We reserve the right to change the Terms and Conditions at any time and it is your responsibility to check regularly before placing a purchase order. This does not affect your statutory rights. This site does not collect personal data of users outside of the US in accordance with GDPR regulations.

  1. Terms of Service 

By placing an order via our website (rotoramerica.com), you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price. 

Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or force majeure for which we will not be responsible. Please see our Delivery information section. 

In order to contract with ROTOR America you must be over 18 years of age. We retains the right to refuse any request made by you. If your order is accepted, we will inform you by email and we will confirm the identity of the party which you have contracted with. This will usually be ROTOR America or may in some cases be a third party. Where a contract is made with a third party ROTOR America is not acting as either agent or principal and the contract is made between yourself and that third party and will be subject to the terms of sale which they supply you. When placing an order, you undertake that all details you provide to us are true and accurate, that you have access to provided email accounts and contact numbers, that you are an authorized user of the credit or debit card, or bank account used to place your order and that there are sufficient funds to cover the cost of the goods. All prices advertised are in US Dollars and subject to such changes. 

  • Our Contract 

When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order. This email will only be an acknowledgement and will not constitute acceptance of your order. ROTOR America retains the right to accept or reject this offer before processing the order. A contract between us for the purchase of the goods will not be formed until your payment in full has been approved by us, the prices have been verified, and the order has been processed and dispatched. A second email will be sent confirming these arrangements and the title of goods will not be transferred until they have been dispatched. 

  • Pricing and Availability

Whilst we try and ensure that all details, descriptions and prices which appear on this website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered, we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. Delivery costs will be charged in addition; such additional charges are clearly displayed and updated where and when applicable and included in the ‘Grand Total’. 

The website may contain typographical errors or other errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. We reserve the right to refuse to fulfill any orders that you may place based on information on the website that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding pricing, shipping, payment terms, or return policies. 

  • Fair Purchase Policy

ROTORAmerica.com business model is not to sell items in bulk quantities to other retailers or bicycle manufacturers. We reserve the right to refuse or cancel any orders which we suspect are beyond the requirements for an individual or club arrangement.   1. Returns
We want you to be completely satisfied with your purchase from our online store. If you need to return an item, please review the following policy:
You have 14 days from the date of receipt to initiate a return.
  • The item must be in new, saleable condition with all original tags and packaging intact. Any items that are returned without the original tags or packaging, or that show signs of use, installation, or damage, may be subject to a partial refund, determined on a case-by-case basis at our discretion.
  • To initiate a return, please contact us by email or phone. We will provide you with instructions on how to proceed with the return process.
  • Once we receive your returned items, we will process your refund within 5-7 business days. If the product shows signs of use, installation, or damage and only qualifies for a partial refund, the refunded amount will be returned via store credit for future use. Rotor America does not provide partial refunds via any other method. New, unused, uninstalled, and undamaged items will be refunded in the form of original payment. 
  • Shipping and handling fees are non-refundable, except in cases where the item received was defective or damaged.

  • Unwanted Item 

If you change your mind on your purchase, you have 14 days to return it for a refund! All Goods must be unused, in a sale-able condition and in their original packaging with all labels still attached. 

There are some exclusions to our returns policy, which are as detailed below: 

Any customized items such as wheel builds cannot be returned unless faulty. 

Please note, that we reserve the right to refuse a return if we believe the purpose was for stock trading/reselling and not personal use. 

We cannot offer exchanges for unwanted items; please do place a new order for any alternative item you require. All refunds will be issued to the original payment method on the order within 7 days of receipt at our warehouse. 

  • How to Return 

If you wish to return unwanted items to us, please follow the simple steps below: 

Please, click on Contact Us section at our site, fill in your contact details and other relevant information. Select Customer Service / Warranties option as subject and let know what the problem with the product is. Our Customer Service department will guide you through the return process as soon as possible after receiving your message. 

Important: All returns are processed in our warehouse; all items must make their way back to our warehouse in Utah before being processed. You’ll receive email confirmation once your return has been processed. 

  1. Faulty, Damaged, Incorrect & Incomplete Item 
  • Faulty Item 

Faulty items are not included in our 14 day return policy as they can be sent back to us at any time within its 2-year warranty. Items sent back to us will undergo an inspection to confirm the fault. 

All goods purchased from ROTOR America are covered by 2 years limited warranty and, generally speaking, warranties cover manufacturing faults and defects including poor workmanship. 

If you feel that your purchase has developed a fault, then please, click on Contact Us section at our site, fill in your contact details and other relevant information. Select Customer Service / Warranties option as subject and we will then get in contact with you for the next steps in completing your claim. 

  • Damaged, Incorrect & Incomplete

 If you have received an item that is damaged, not what you ordered, or is missing parts please contact us with photographs of the issue before returning any goods. Please, click on Contact Us section at our site, fill in your contact details and other relevant information. Select Customer Service / Warranties option as subject and attach the pictures. We will then get in contact with you asap for the next steps in completing your claim, we may be able to solve your problem without you incurring any postage costs. 

  1. Wheels Returns 

If you are not happy with your wheels for whatever reason, you are welcome to return it to us for a refund so long as it is still new and un-used. Please let us know within 14 working days through the Contact Us section at our site, fill in your contact details and other relevant information. Select Customer Service / Warranties option as subject and we will contact back to you as soon as possible to arrange the return with you. 

Please note the following: 

Be sure you are happy with the wheels as once used, returns cannot be accepted. We recommend you keep hold of the packaging just in case you need to return the wheel to us. If you would like to return your wheels within the 14-day period, you will need to cover the cost of returning the wheels, along with ensuring the wheels are securely packaged for transit as originally received. 

Your wheels are covered by the ROTOR manufacturer’s warranty. If your wheels develop a fault within the warranty period, please contact us before returning the product or any of its components as problems can often be resolved without any postage costs being incurred. Select Customer Service / Warranties option as subject and we will then get in contact with you for the next steps in completing your claim. 

For health and safety reasons, please ensure that any returns sent back to us are clean. 

Important: All returns are processed in our Spanish warehouse; all items must make their way back to Spain before being processed. You will receive email confirmation once your return has been processed.

If none of the above situations apply to your case, please contact us directly. 

  1. Availability / Estimated Delivery Times

We do our best to ensure availability of all advertised products and endeavor to dispatch all parts within the quoted time. If there is a delay, we will inform you of this via email and the product will be dispatched as soon as it is available. If you have ordered multiple items they may arrive in separate shipments. 

ROTOR America has no liability to you for any delay in the delivery of products ordered. We will do our best to get all orders sent out as quickly as possible. You have the right to cancel delayed orders at any time, just contact us with your order number. 

Occasionally we find ourselves having to withdraw an item because it has become obsolete or has been discontinued. If you have placed an order for an item that has been made obsolete, we will inform you as soon as possible and offer you an alternative if one is available. 

  1. Payment & Down Payments

Payment over the Internet can be made via our secure check out pages using almost any credit or debit cards. All prices are quoted in USD ($) and include taxes where applicable. It may be necessary to adjust prices in the event of an increase in tax rates, or as a result of a manufacture cost increase. Customers are entitled to a full refund if this is not acceptable.

If a problem in supply should occur, your payment method will be refunded as swiftly as possible. The refund may take a couple of days to show as cleared funds on your account, depending on payment provider.

If you order using a freight forwarder, you may be required to pay import duties and taxes when your order reaches your country. These and any additional charges for customs clearance are your responsibility. In order to improve delivery times your products may be shipped out from different storage locations. We reserve the right to cancel and refund orders shipping to freight forwarders at our discretion.

  1. Delivery 

Our goal is to dispatch orders as quickly as possible and in most cases, all in-stock orders placed before 1:00pm Mountain Standard Time will be shipped the same day when selecting UPS. Due to carrier inconsistencies, all USPS order may require 1 additional business day handling time. We reserve the right to change shipping provider at our discretion.  

Dispatch time may vary according to availability and any guarantees or representations made relating to delivery times are subject to any delays resulting from postal delays or force majeure for which Rotor America will not be responsible. We reserve the right to change shipping provider at our discretion. If your delivery address is in a remote area delivery times may be extended, depending on where exactly your order is shipped. 

Orders over $250 qualify for free economy shipping* and will be shipped with carrier of our discretion, Generally UPS. Rotor America strongly advises all shipments to be delivered to a secure address. We are not responsible for packages with incorrect shipping address being provided or that are lost or stolen after delivery.  For your safety we may require signature confirmation on any order over $250. 

*Power Meters, Hawaii, and Alaska exluded.

ROTOR America strongly advises against deliveries to be made to hotels or third-party couriers.  Any orders made, to be sent to a hotel or a third-party courier, are entirely at the risk of the client.  Therefore, we regret to inform that ROTOR America cannot accept any liability for orders that fail to arrive to the hotels or third-party courier or are damaged on receipt.  We will, however, do what we can to help in cases like these. 

If your shipping address does not have a secure area for deliveries, we recommend contacting us directly to arrange for signature confirmation on high-dollar orders. We are not responsible for packages that are lost or stolen after delivery. Porch pirates are real. It is your responsibility to know the risk level of your area and take precautions as necessary. 

  1. Cancellations

Orders may be cancelled at any time before they are prepared by our team. If the item has already been dispatched, then please see our returns policy. For any order Cancellations / changes please call us for immediate support.

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. You have a right to return your order in writing (except for customized products) 14 working days beginning with the day after the day on which the consumer receives the goods. Please see returns policy for guidance on method and costs of return. 

  1. Reviews and Comments

We encourage you to leave reviews, comments and product questions on our website. We regularly monitor this content and we reserve the right to remove, reject or edit it at any time. When submitting information to our website as a review, product question or customer comment you understand that what you have submitted is not copyright protected and you are permitting its appearance on the ROTOR America website. 

  1. Liability

We shall not be liable for incidental or consequential damages or expenses. This includes, but is not limited to, damage to property, lost income, profits, economic or commercial losses and third parties claims. 

We will do our best to get all orders dispatched as quickly as possible. We have no liability to you for any delay in the delivery of products ordered. You have the right to cancel delayed orders at any time and get a refund prior to the item being dispatched. 

This warranty does not affect your statutory rights. 

  1. Privacy, Copyright and Disclaimer

We will never sell or pass on your name and address to any other organization without your consent. Your details are confidential, and you will never receive unsolicited mail as a result of ordering from RotorBike. 

ROTOR America maintains a strict privacy policy in full accordance with applicable laws and regulations.

We expect you to maintain the confidentiality of your login information for your ROTOR America account. 

All content included in this site, text and graphics (including copyright), is owned and controlled by ROTOR America. In accessing the ROTOR America web pages, you agree that you may only download the content for your own individual and non-commercial use. You are not permitted to copy, broadcast, download, store, transmit, show or play in public, adapt or change in any way the content of these pages for any other purpose whatsoever, in any medium, without the prior written permission of ROTOR America.

  1. Termination of Contract

The presentation of products in this online shop does not represent a legally binding offer but a non-binding online catalogue. By clicking on the button ‘Buy’ / ‘Order and Pay’, you place a binding order for the products in your shopping basket. We send you a confirmation of receipt of your order by automated e-mail when receiving the order straight after it is placed. With this e-mail, the purchase agreement comes into effect.

  • Minimum spend required (exclusive of any shipping costs). 
  • ROTOR America reserves the right to end promotions at any time. 
  • Discount vouchers & promotions are only redeemable against in-stock items. 
  • Orders for out of stock items cannot be accepted. 
  • Discount vouchers/promotions cannot be used to purchase gift vouchers. 
  • Discount vouchers/promotions cannot be used in conjunction with any other voucher offer. 
  • These codes are single use per account. 
  • Discount vouchers/promotions cannot be applied retrospectively. 
  • Orders containing excluded products are not valid for any promotion. 
  • Discount codes cannot be applied retroactively. Rotor America will not apply discount codes to orders that have been placed before the time and duration of sale.
